These Terms of Use ("Terms") govern access to and use of the GoGrade AI website, platform, and related services (collectively, the "Services") operated by DevsTree IT Services Private Limited ("we", "us", or "our"). By accessing or using the Services, you agree to these Terms on behalf of yourself or the institution you represent.
1. About GoGrade AI
GoGrade AI is an AI-powered assessment and evaluation platform for educational institutions. It helps schools, colleges, coaching centres, and similar organisations upload answer sheets, evaluate responses using institution-defined answer keys and rubrics, review AI-suggested scores, publish report cards, and generate assessment insights.
The Services are provided on a multi-tenant basis. Each institution receives a dedicated workspace (for example, a school subdomain) with controlled access for school administrators, branch administrators, principals, teachers, students, parents/guardians, and other authorised roles.
2. Who may use the Services
The Services are intended for authorised representatives of educational institutions and their invited users. You must be legally capable of entering into a binding agreement and must have authority to bind your institution where you accept these Terms on its behalf.
Students and parents may access limited features (such as published report cards) only when invited or enabled by their institution.
3. Accounts, access, and security
- You must provide accurate registration and profile information.
- You are responsible for safeguarding login credentials and for activity under your account.
- Institutions must ensure that only authorised staff, students, and parents receive access.
- Platform (super-admin) users may be required to use multi-factor authentication.
- You must notify us promptly at support@gograde.ai of suspected unauthorised access or security incidents.
4. Institutional responsibilities
Your institution remains the controller of student and academic data uploaded to GoGrade AI. You are responsible for:
- Obtaining any required consents and lawful bases to process student, parent, and staff data.
- Ensuring uploaded question papers, answer keys, rubrics, and answer sheets are accurate and authorised for use.
- Reviewing AI-generated scores where educational or examination integrity requires human oversight.
- Configuring roles, branches, academic years, and access permissions appropriately.
- Complying with applicable education, examination, and data-protection laws in your jurisdiction.
5. AI evaluation and human oversight
GoGrade AI uses artificial intelligence (including third-party AI model providers) to recognise and evaluate answers. AI outputs are assistive. They may contain errors or inconsistencies.
Teachers and authorised reviewers can review, adjust, or override AI scores. Final academic decisions remain with your institution. You should not treat AI scores as the sole basis for high-stakes decisions without appropriate human review.
6. Credits, licences, and fees
Access to AI evaluation may consume institution-level credits or other usage units sold or allocated under a commercial arrangement with us. Seat limits, licence activation, trials, and credit top-ups may apply as agreed at provisioning or in a separate order form / quotation.
Prices, taxes (including GST where applicable), and payment terms are those stated in your quotation, invoice, payment link, or written agreement. Unless otherwise agreed in writing, fees are charged in INR.
7. Payments
We may collect payments using authorised payment partners, including Cashfree Payment Links (or other gateways we designate). Payment confirmation, credit allocation, and licensing may depend on successful settlement and our internal verification processes.
You agree to provide accurate payer details when completing a payment link. Failed, abandoned, or declined payments do not entitle you to Service usage beyond what has already been provisioned.
8. Acceptable use
You must not:
- Misuse the Services to violate exam integrity, academic honesty policies, or applicable law.
- Upload unlawful, infringing, harmful, or highly sensitive content beyond what the Services are designed to process.
- Attempt to probe, disrupt, reverse engineer, or bypass security or tenancy isolation.
- Share account access in a way that compromises student data confidentiality.
- Use the Services to build a competing product through systematic scraping or extraction of proprietary models, prompts, or platform logic.
9. Intellectual property
We and our licensors own GoGrade AI, including software, branding, UI, documentation, and underlying systems. Your institution retains ownership of its content (question papers, rubrics, answer sheets, institutional data), subject to the licence needed for us to host, process, and evaluate that content to provide the Services.
Feedback you provide may be used to improve the Services without obligation to you.
10. Third-party services
The Services may rely on third parties such as cloud hosting/object storage, email delivery, analytics, AI model providers, and payment processors (for example, Cashfree). Their use is subject to their respective terms and our Privacy Policy.
11. Trials and changes to the Services
We may offer trials or limited evaluations. Trial features, duration, and credit grants may change. We may update, suspend, or discontinue features with reasonable notice where practicable, especially for material reductions affecting paying institutions.
12. Suspension and termination
We may suspend or terminate access for unpaid amounts, security risk, breach of these Terms, or as required by law. Institutions may stop using the Services subject to any committed commercial terms. Upon termination, access to institutional data follows our retention practices and any written offboarding arrangement.
13. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT AI EVALUATION WILL BE ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR EVERY EXAMINATION CONTEXT WITHOUT HUMAN REVIEW.
14. Limitation of liability
To the maximum extent permitted by law, DevsTree IT Services Private Limited will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or examination outcomes. Our aggregate liability arising out of the Services is limited to the fees paid by the relevant institution to us for the Services in the three (3) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your institution's misuse of the Services, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.
16. Governing law and disputes
These Terms are governed by the laws of India. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction, subject to any mandatory protections available to you under applicable law.
17. Changes to these Terms
We may update these Terms from time to time. Material updates will be posted on this page with a revised "Last updated" date. Continued use after the effective date constitutes acceptance of the updated Terms.
